Tenancy Termination Letter Malaysia: Notice & Handover

A tenancy termination letter in Malaysia should identify the agreement, the reason it can end, the correct end date and the required service method. First decide whether you are giving notice of non-renewal, exercising a break clause, or asking the other party to agree to an early exit. These are different actions and need different wording.

The samples below are original drafting aids for routine residential situations. They do not create a right to terminate. For arrears, alleged breach, disputed possession or an unclear clause, have the agreement and proposed notice reviewed before sending it.

Choose the right kind of letter

A two-month notice provision for non-renewal may not permit departure halfway through a twelve-month term. Likewise, an early-exit clause may require a minimum stay or supporting documents. Read the whole clause and any amendments.

If both parties agree to bring the arrangement to an end on new terms, document that agreement. Section 63 of the Contracts Act 1950 addresses agreed rescission and alteration. A tenant's request and the landlord's acknowledgement of receipt are not necessarily an agreed release.

Check notice timing and delivery

Create a short notice worksheet before drafting:

  1. Agreement: date, parties, property and relevant clause number.
  2. Right or event: expiry, an applicable break condition, or proposed mutual release.
  3. Notice period: copy the actual unit of time; calendar months and a fixed number of days can produce different dates.
  4. Service: named recipient, notice address, permitted delivery method and any deemed-receipt rule.
  5. End date: check it against both the clause and effective service date.
  6. Evidence: retain the signed letter, delivery record and response.

Do not calculate a contractual deadline only from the date typed at the top of the letter. Posting, delivery and deemed receipt may occur on different days. Allow time for the required method, especially around weekends or holidays. If the result is uncertain, settle the date with professional advice rather than copying a generic period.

Sample 1: tenant's notice of non-renewal at expiry

Use this when the tenant intends to leave at the existing term's end and the agreement supports the notice being given. Replace the bracketed fields and check any automatic-renewal provision first.

The proposed handover appointment should fit the contractual end date. Do not leave a mismatch between “vacating”, “returning keys” and the date used for final rent.

Sample 2: request for an agreed early exit

Use this to start a negotiation when there is no clear unilateral right to leave on the proposed date. It is a request, not confirmation that liability ends.

This request does not itself terminate or vary the tenancy. If we agree, I propose that we sign a written record of the release, handover and any obligations that remain outstanding.

If agreement is reached, specify whether future rent claims are released, what sums remain payable, and when that release takes effect. Do not leave those points to an ambiguous “okay” in a chat. If the parties instead decide to continue, use the renewal checklist and sample request.

What a landlord's notice needs to address

A landlord should identify the actual contractual or legal basis for requiring the tenancy to end, meet applicable notice and remedy requirements, and preserve evidence. A notice based on alleged breach should accurately state the breach and any required opportunity to remedy it. The tenant samples above are not breach notices or court documents.

If a former lawful occupier remains after the tenancy has ended, section 7(2) of the Specific Relief Act 1950, official reprint hosted by FAO requires recovery of possession through court proceedings. Handover and deposit reconciliation checklist

Agree a joint inspection if possible and compare against the starting inventory. Keep dated photographs, meter readings and a signed record of keys and access cards returned. For a room rental, distinguish the bedroom's condition from the shared areas.

Record final rent, outstanding bills and each proposed deduction separately. Ask for the clause and evidence supporting a deduction. Check the contract's refund procedure; do not assume every tenancy has a universal thirty-day refund deadline or that the whole deposit is automatically forfeited when a tenant leaves early.

Frequently Asked Questions

Is two months' notice always enough to terminate a tenancy?

No. Check whether termination is allowed in the circumstances, the applicable notice period, its calculation and the required method of service. A notice period alone does not create a right to end a fixed term early.

Can I send a tenancy termination letter through WhatsApp?

Check the agreement's service clause and applicable legal requirements. A message can help coordinate handover, but do not assume it replaces the prescribed service method. Keep evidence of delivery and receipt.

Does requesting an early exit release me from the agreement?

A request alone does not settle the exit. Follow an applicable contractual right or obtain a clear agreement on release, final rent, deposits, handover and any remaining obligations.

Can a landlord change the locks after the notice expires?
