Room Rental Agreement Malaysia: Clauses & House Rules

A room rental agreement in Malaysia should identify the exact room, shared facilities, rent, utility formula, deposit terms and house rules. Replacing the address in a whole-house template is not enough: it can leave unclear who may enter the bedroom, who pays when another room is empty, and who bears shared-area damage.

This checklist is for an ordinary residential room arrangement. A head tenant offering a sublet, an owner living in the same home, and a company operating accommodation can need different terms and permissions. Have the actual arrangement reviewed where those distinctions matter.

Confirm who has authority to rent the room

Ask whether the contracting party is the owner, an authorised representative or a head tenant. Match that explanation to the agreement and payment instructions. If it is a sublet, review the head tenancy and any required owner's consent before paying a deposit.

Inspect the room itself. Check its access, ventilation, exits and permitted occupancy with the relevant local authority and building management where needed. A signed or stamped agreement does not establish that a partition or conversion is approved. Keep this permission check separate from negotiating rent.

Describe exclusive and shared space precisely

Use a room identifier that both parties can recognise: for example, “Bedroom 2, marked on the attached floor plan”. List the furniture, keys, access cards and condition photographs under the same identifier. A sketch or annotated plan can prevent a later disagreement about which room was offered.

For separate room agreements, specify each tenant's obligations. If everyone signs one whole-unit agreement, examine the joint obligations before assuming each person is responsible only for a bedroom's share. Sections 43–45 of the Contracts Act 1950 address joint promises; the contract structure matters.

Original sample room-description clause

This is suggested drafting to discuss, not a complete agreement or a determination of the arrangement's legal status.

The rented room is [room identifier] at [full address], shown on the attached plan. It is for occupation by [named permitted occupant(s)]. The room inventory is Schedule [number].

The tenant may share [listed spaces and facilities] with [other authorised occupants]. The following areas and items are excluded: [details]. Parking is [not included / identified bay].

The parties agree that routine access to the rented room for inspection or repairs will follow clause [number], including its notice and scheduling requirements. Emergency access arrangements are set out in that clause separately.

Complete the access clause rather than leaving an unrestricted right to enter. Agree a practical notice method, suitable visiting times and how urgent repairs will be handled. Keep a shared-home chat group for coordination, while using the contract's required method for formal notices.

Make the utilities formula auditable

“Utilities shared fairly” is difficult to administer. State the electricity, water and internet arrangement individually. Decide whether an amount is included in rent, separately metered or allocated from actual bills. Identify who holds each account and who provides copies of statements.

For an allocation based on actual bills, settle these points before signing:

Illustrative three-room arrangement: the parties agree to divide each month's actual shared bills into three room shares, with the landlord bearing vacant-room shares. Electricity RM180, water RM30 and internet RM90 total RM300. Each room's share is RM100. If one room is empty for the entire billing period, the two occupied rooms still pay RM100 each and the landlord bears RM100 under this particular clause.

This example is a budgeting method to negotiate. It is not an electricity tariff or authority to resell electricity at a markup. Separate meters, commercial accommodation and supplier restrictions need their own checks. Also avoid assuming that describing a payment as “utilities” automatically excludes it from stamp-duty consideration.

Attach house rules before collecting money

Write rules that occupants can actually follow. Cover guests, smoking, cooking, noise, shared cleaning, rubbish, food storage and how complaints are raised. State how changes can be agreed rather than reserving an undefined power to add charges later.

For strata homes in Peninsular Malaysia and Labuan, the Strata Management Act 2013 provides for prescribed and additional by-laws that can bind tenants and occupiers, including sections 32 and 70. Obtain the applicable building rules. Your room agreement cannot promise facilities or uses that conflict with binding rules. Sabah and Sarawak require their own local-law checks.

Distinguish a house rule from a charge. For example, a cleaning rota tells occupants what to do; a cleaning deduction needs an agreed basis and supporting records. Avoid making every occupant automatically responsible for unidentified damage without defining and reviewing that liability.

Record deposits and the room's starting condition

State security deposit, utility deposit and advance rent as separate amounts. Give receipts. Identify the deductions the parties agree may be made, the supporting evidence, the reconciliation deadline and the refund method. A security deposit should not be silently treated as the last month's rent.

At check-in, record bedroom condition and any existing common-area damage. Photograph meter readings if relevant. At check-out, compare against the same record, list returned keys and cards, and identify any unresolved utility bill separately. This makes it easier to distinguish the tenant's room from damage elsewhere in a shared home.

Set the term, exit process and stamping responsibility

Include start and end dates, rent due date, renewal procedure, notice addresses and any agreed early-exit mechanism. If the occupant wants to leave early, identify the contractual route or negotiate a written release. Finding a replacement occupant does not by itself settle the outgoing tenant's obligations. Frequently Asked Questions

Can I use a whole-house agreement for a room rental?

It needs adaptation. Identify the exclusive room, shared spaces, permitted occupants, utility allocation and liability for common-area damage. A whole-house description can promise more space or responsibility than intended.

How should utilities be divided between room tenants?

Agree a clear formula before signing, including the billing period, receipts, vacancies, partial months and any separate meter. An equal split is one possible negotiated method, not a rule for every property.

Does signing a room rental agreement approve a partitioned room?

No. Contract terms and stamping do not establish compliance with planning, building, fire-safety or applicable strata requirements. Verify the actual room and permitted use separately.

Is a room rental deposit always two months?

Do not assume a fixed amount. State the agreed security deposit, utility deposit and advance rent separately, with receipts and a clear reconciliation and refund process.
